Project Covenants
- The land area donated by each community for installation of the water project remains the property of the community. The land area will revert to the community whenever the water project is terminated and/or is no longer needed by the community. Notice of the termination will be duly signed by leaders of the community (such as Umunna Chairman and Ward Councilor) and delivered to CCSF with a three month notice of intention to terminate the water project.
- All equipment (such as generator, solar panel, water tanks, tank stand, valves, faucets, fence, pipes, etc.) associated with the water project remains the property of CCSF. The community shall not claim ownership of such equipment under any circumstances. Also, CCSF shall not be obstructed or barred from entering the water project area to remove any equipment associated with the project and owned by CCSF.
- Water produced from the project shall not be sold or commercialized in any manner. Water tankers shall be barred from filling their tanks with water from the project either for sale or any other purposes. No pipes or hoses shall be connected to the water project for delivery of water to another location outside of the project area.
- All construction activities ( such as building of houses and other structures) are barred from sourcing water from the project. Water from the project is restricted to use by individuals or families for routine activities such as drinking, cooking, washing, bathing, cleaning, and other communal/household activities.
- The land area donated by the communities may be considered inadequate if it was determined through seismic surveys or other geologic evaluations that the underlying aquifer will not be sufficient either in quality or quantity to sustain water supply over an estimated project life of at least ten years. In such cases, the community will be required to provide another land area as substitute. The water project shall be suspended or deferred if the community did not donate another area for the water project within six months after due notification.
- Decisions made by CCSF and her agents with regards to the water project are not subject to arbitration or litigation of any kind. The communities will be required to indemnify CCSF and her agents in all actions related to the water project.
- Each community shall agree to these covenants and other guidelines that will be formalized in a document to be signed between the leaders of the community and CCSF.
